Legal Compliance & Data Protection
FERPA Compliance (United States):
This system is designed to comply with the Family Educational Rights and Privacy Act (FERPA) 20 U.S.C. § 1232g, which protects the privacy of student education records. We implement appropriate safeguards to protect personally identifiable information (PII) from education records.
COPPA Compliance:
For students under 13 years of age, this system complies with the Children's Online Privacy Protection Act (COPPA). Parental consent is required before collecting, using, or disclosing personal information from children under 13.
Wisconsin State Law Compliance:
This system complies with Wisconsin Statute § 118.125 (Pupil Records) and Wisconsin Statute § 16.61 (Public Records Retention). All pupil records are treated as confidential and retained in accordance with state law.
Educational Records Accuracy
All educational records, including but not limited to attendance, grades, assignments, and student information, are maintained in accordance with FERPA and applicable regulations. While we implement rigorous data validation and security measures, users are responsible for verifying the accuracy of information they enter or rely upon.
Third-Party Services
This application utilizes third-party services including:
- Supabase (database and authentication) - Subject to Supabase Terms of Service
- Vercel (hosting) - Subject to Vercel Terms of Service
- Google APIs (Classroom integration) - Subject to Google API Terms of Service
While these services are selected for their security and reliability, Neeraj's AI Software is not responsible for any service interruptions, data breaches, or issues arising from third-party service providers beyond our direct control.
Security & Data Breach Notification
We implement industry-standard security measures including encryption (TLS/SSL), role-based access control (RBAC), multi-factor authentication, and regular security audits. However, no method of transmission over the internet or electronic storage is 100% secure.
Data Breach Notification: In the event of a data breach affecting personal information, we will notify affected users and appropriate authorities in accordance with applicable laws within 72 hours of discovery, as required by GDPR and other data protection regulations.
Limitation of Liability
IMPORTANT LEGAL NOTICE: TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL NEERAJ'S AI SOFTWARE, NAS, OR THE SCHOOL ADMINISTRATION BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR DATA USE, WHETHER IN AN ACTION IN CONTRACT, TORT (INCLUDING NEGLIGENCE), OR OTHERWISE, ARISING OUT OF OR IN CONNECTION WITH THE USE OF THIS APPLICATION, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
The total aggregate liability of Neeraj's AI Software for all claims arising out of or relating to this application shall not exceed the amount paid by the user (if any) to access this service in the twelve (12) months preceding the claim.
User Responsibility & Acceptable Use Policy
Users are responsible for:
- Maintaining the confidentiality of their login credentials and not sharing accounts
- Reporting any security concerns, vulnerabilities, or data inaccuracies immediately
- Complying with all applicable laws, regulations, and school policies when using the system
- Not attempting to bypass security measures or access unauthorized data
- Not using the system for any illegal, harmful, or malicious purposes
Consequences: Violation of these terms may result in immediate suspension or termination of access, removal of content, notification to school administrators and law enforcement, and potential legal action.
